General Terms and Conditions of Use of the Application Memoz
The following Terms of Use govern your (“you” or “user”) access to and use of Memoz - Registros Pedagógicos (“we” or “us”), including its proprietary mobile application, website, and all related content, features, and services (collectively, “Memoz”). By using Memoz in any way, you agree to abide by and be bound by these Terms, along with our Privacy Policy available at https://memoz.app/privacy-policy, which explains how we collect, use, and share your personal data. If you do not agree to these Terms, you must immediately exit and cease using Memoz.
1. Objective
The platform aims to license the use of its applications and other intellectual property assets, offering tools designed to assist and streamline users' daily activities.
The platform provides the following service:
An app tailored to efficiently and systematically document children's experiences during the school routine. Features include photo uploads, text entries, and audio recordings with transcription options. Filters enable easy access to records by period, class, student, development stage, and activities. This makes the app a valuable resource for preparing reports, building portfolios, and showcasing work within the school environment.
2. Acceptance
This Agreement establishes obligations freely and voluntarily undertaken between the platform and individuals or legal entities using the website or application, for an indefinite period. By using the platform, the user fully accepts these terms and commits to complying with them, under penalty of applicable sanctions.
Acceptance of this instrument is essential for accessing and using any services provided by the company. If the user does not agree with the provisions herein, they must refrain from using the services.
3. User Access
The platform will employ all technical solutions available to ensure 24/7 service access. However, navigation on the platform or its pages may be interrupted, limited, or suspended for updates, modifications, or any necessary action to ensure proper functioning.
4. Registration
Access to certain features of the platform requires prior registration and, depending on the chosen products or services, may require payment of a specific amount. When registering, the user must provide complete, accurate, and up-to-date information. The user is solely responsible for keeping this information updated and ensuring its truthfulness.
The user agrees not to share their registration or access credentials with third parties and will be fully responsible for their use. Minors under 18 years of age and individuals lacking full legal capacity must obtain prior express consent from their legal guardians to use the platform, services, or products.
Upon completing the registration, the user expressly declares their legal capacity to enjoy the services and products freely. A valid email address must be provided for all necessary communications from the platform.
The user will be assigned a login and personal password, ensuring individual access to the platform. The user is solely responsible for maintaining the confidentiality and security of their password to prevent unauthorized access.
Any activity performed with the user's login credentials is their responsibility, and the platform must be informed immediately of any misuse. The user may cancel their registration at any time, provided there are no outstanding debts.
Upon accepting the Terms and Privacy Policy, the user authorizes the platform to collect, use, store, process, and share information derived from the use of its services, as outlined in the Privacy Policy.

6. Responsibilities
The user is responsible for:
a) Defects or technical issues originating in the user's own system;
b) Proper use of the platform, services, or products offered, maintaining good conduct, respect, and cordiality among users;
c) Compliance with and adherence to the set of rules outlined in these Terms of Use, the Privacy Policy, and national and international laws;
d) Protecting access data to their account/profile (login and password).
The platform is responsible for:
a) Providing information about the characteristics of the service or product;
b) Defects and issues found in the service or product offered, provided they are caused by the platform;
c) The information it has disclosed, with the understanding that comments or information shared by users are the sole responsibility of the respective users;
d) Preventing illegal content or activities conducted through its platform.
The platform is not responsible for external links included in its system that may redirect users to environments outside its network.
External links or pages included in the platform must not serve commercial or advertising purposes, nor may they contain illegal, violent, controversial, pornographic, xenophobic, discriminatory, or offensive content.
7. Intellectual Property
This Terms of Use grants users a non-exclusive, non-transferable, and non-sublicensable license to access and use the platform and the services and products made available through it.
The structure of the website or application, trademarks, logos, trade names, layouts, graphics, interface designs, images, illustrations, photographs, presentations, videos, written content, sound and audio content, computer programs, databases, transmission files, and any other information or intellectual property rights of Memoz are duly reserved, in accordance with the provisions of the Industrial Property Law (Law No. 9.279/96), Copyright Law (Law No. 9.610/98), and Software Law (Law No. 9.609/98).
This Terms of Use does not assign or transfer any rights to the user, meaning that access does not grant any intellectual property rights to the user, except for the limited license granted herein.
The user's access to and use of the platform is personal, individual, and non-transferable. Any unauthorized use, whether for commercial or non-commercial purposes, is strictly prohibited and constitutes a violation of Memoz's intellectual property rights, subject to penalties under applicable law.
8. Sanctions
Without prejudice to other applicable legal measures, Memoz reserves the right to warn, suspend, or terminate the user's account at any time:
a) for violating any provision of these Terms;
b) for failing to fulfill their obligations as a user;
c) for engaging in any fraudulent, intentional, or offensive behavior toward third parties.
9. Termination
Failure to comply with the obligations set forth in these Terms of Use or with applicable law may, without prior notice, result in the immediate unilateral termination by Memoz and the blocking of all services provided to the user.
10. Amendments
The provisions described in this document may be unilaterally amended at any time by Memoz to adapt or modify the services, as well as to meet new legal requirements. The changes will be communicated either through the Memoz's website or the application, and the user may choose to accept the updated terms or discontinue using the services if subscribed to any service.
The services offered may, at any time and unilaterally, be discontinued, modified in their characteristics, or restricted in terms of use or access, without prior notice.
11. Privacy Policy
In addition to this Agreement, the user must consent to the provisions contained in the respective Privacy Policy, which will be made available to all interested parties within the platform's interface.
12. Jurisdiction
For the resolution of disputes arising from this agreement, Brazilian law shall be fully applied. Any disputes must be submitted to the court of the jurisdiction where the company's headquarters are located.
